THE TRAVELERS CHEQUE CARD FROM AMERICAN EXPRESS CARDHOLDERS AGREEMENT (UNITED STATES  VERSION)

This Cardholder Agreement ("Agreement") governs your use of the Travelers Cheque Card (the "Travelers Cheque Card" or "Card") issued by American Express Travel Related Services Company, Inc. By signing or using the Card, you are agreeing to the terms and conditions of this Agreement. In this Agreement, the terms "you" and "your" refer to the purchaser of the Travelers Cheque Card, as well as, the Travelers Cheque Cardholder, that is, the person to whom the Card was issued. The terms "we," "our," "us," and "American Express" refer to American Express Travel Related Services Company, Inc.

THE TRAVELERS CHEQUE CARD
The Travelers Cheque Card is a travel money card that is available in three currencies: United States Dollars ("US Dollars"), Pounds Sterling, and Euros. Like a paper Travelers Cheque, the Card is a prepaid payment product. The Card is not a credit card, charge card or a debit card linked to your checking or savings account. You must load funds onto the Card and activate the Card before you use it. For Customer Service issues, please call us toll free within the United States at 1-888-412-6945 or call us collect from outside the United States at 1-801-945-9450 ("Customer Service Number"). The Travelers Cheque Card is our property.

Our issuance and/or activation of a Card are based on the information you provide to us during the enrollment or activation process. We reserve the right (i) to refuse to issue you a Card, and (ii) to refuse to activate a Card that has been sent to you as part of a promotional campaign. You must be at least eighteen (18) years old to purchase a Card and the Travelers Cheque Cardholder must be at least thirteen (13) years old and a United States resident to be issued a Card or have a Card activated. You agree (i) to provide personal information in the enrollment or activation process that is accurate and complete; (ii) to update your personal information as necessary so that it remains accurate and complete; and (iii) not to impersonate any other person, operate under an alias or otherwise conceal your identity.

When you enroll for, or request to activate, a Card, you must indicate an initial load amount of at least $300, £200 or €250, up to a maximum of $2750, £1500 or €2200 ("Initial Load Amount") that will be charged to the US Dollar denominated payment account you designate (hereafter known as the "Associated Account"). Unless you provide us with an alternative payment account at a later date, the Associated Account will also be used for Reloads, as defined in the section below titled "Reloading the Card." You agree that we are authorized to charge the Initial Load Amount, any Reloads and any other applicable fees or charges described herein, to the Associated Account. We reserve the right to limit what types of accounts (e.g., credit, charge, debit) you can designate as an Associated Account at any time, without notice, in our sole discretion.

An issuance fee ("Issuance Fee") will apply when you first load a Card purchased in person, by telephone or online at www.americanexpress.com/travelerschequecard. In addition, when you purchase a Card in a currency other than US Dollars (e.g., Pounds Sterling or Euro), the Initial Load Amount and any Reloads will be converted from US Dollars to the currency of the Travelers Cheque Card using a conversion rate that is acceptable to us. This conversion amount will be charged to your Associated Account at the same time as the Initial Load Amount or any Reload. Currently, the conversion rate we use for initial loads and Reloads is not greater than the highest official rate published by a government agency, or highest interbank conversion rate identified by us from customary banking sources on the conversion date or prior business day, increased by three percent (3%).

BEFORE USING THE CARD
Before using the Card, you must: (i) activate the Card by calling the number indicated on the sticker on the front of your Card; and (ii) sign the reverse of the Card. Write down your Card number and the Customer Service Number on a separate piece of paper in case the Card is ever lost or stolen. At the time of activation, for your protection and for regulatory purposes, we may request, and you agree to provide, some additional identification verification information such as your home phone number, date of birth, social security number and zip code. We may use this data for a range of purposes, including but not limited to facilitating refunds if your Card is lost or stolen, enhancing usage at merchants that may require zip code authorization, and aiding in collection efforts in the event of a Shortage, as defined herein. We will hold your information in confidence in accordance with the section below entitled "Data Protection and Privacy". If you do not wish to provide the data, or if the data you provide us cannot be appropriately verified, we reserve the right to cancel your Card and reimburse you for the Initial Load Amount within ten (10) business days. Such reimbursement may be implemented, at our choice, either by crediting the amount to your Associated Account, or by sending you a check.

Please Note: If you purchased a Card in-person for an Additional Cardholder, as defined in the section titled "Additional Travelers Cheque Cards," you must call the number indicated on the sticker on the front of the Card to provide us with your identification information and complete other requirements. The Additional Cardholder will also need to call that number to activate the Card and set up a personal identification number to use the Card at an automated teller machine ("ATM").
