THE TRAVELERS CHEQUE CARD FROM AMERICAN EXPRESS CARDHOLDERS AGREEMENT (UNITED STATES  VERSION)

 
INFORMATION ABOUT AVAILABLE FUNDS
The value of the funds that are loaded onto the Card and that are available for spending is referred to herein as the "Available Funds." Your Available Funds are held in secure "permissible investments" and are subject to state regulatory supervision. No interest will be paid to you with respect to such Available Funds. The total amount of Available Funds on your Card, together with any other Additional Cards, cannot exceed $2750, £1500 or €2200 at any time. As you use the Card, the Available Funds will be reduced by the full amount of each purchase or ATM transaction, including taxes and any other fees. You must keep track of the amount of Available Funds. To obtain your Available Funds balance or to request information about previous transactions call the Customer Service Number or visit us online at www.americanexpress.com/travelerschequecard. Your Available Funds balance will reflect all authorization requests that have been submitted by establishments or ATM operators. You may request a paper statement of your Card transactions, but we reserve the right to deduct a $5, £3 or €4.50 fee from your Available Funds for processing and mailing the statement to you. Paper statements for an Additional Cards can be requested by you or by the owner of the Associated Account. If you believe a transaction has been incorrectly posted to your Card (e.g., the same transaction has been posted twice or for the incorrect amount) you must notify us immediately, but no later than sixty (60) days from the date of the transaction, by calling the Customer Service Number. You must tell us your name, Card number and the date and dollar amount of the suspected error. If we ask you to put your complaint or question in writing, you agree to do so within 5 business days from our request. We will tell you the results of our investigation within 60 days after we hear from you
 
"VALID THRU" DATE/AVAILABLE FUNDS DO NOT EXPIRE
While the Card has a "valid thru" date indicated on the front of the Card, your Available Funds do not expire. The "valid thru" date is the date after which you may not use that Card. If Available Funds remain on the Card after the "valid thru" date, contact us at the Customer Service number for instruction on how to obtain replacement plastic or redeem the Available Funds. Subject to applicable law, we reserve the right to charge you $5, £3 or €4.50 for a replacement Card or, if you request that we refund the amount of any Available Funds remaining on the Card after the "valid thru" date, we reserve the right to charge you a cancellation fee of $10, £5.95 or €7.95. Before refunding any Available Funds, we may hold the Available Funds for ten (10) business days after you request a refund to ensure that all transactions have posted to our system. We reserve the right to decline to issue a replacement Card.
 
USING THE CARD
Once loaded, you can use the Card at virtually all establishments that accept American Express Cards. Some usage restrictions apply; see the section entitled "Usage Limitations" below. To use the Card at an establishment that accepts American Express Cards, present the Card at the time of payment and sign the receipt with the same signature you have used when you signed the Card. You can also access the Available Funds on your Card at an ATM that participates in the Express Cash network maintained by American Express. To obtain cash from ATMs, you must select your own personal identification number (see "ATM Transactions" below).

You agree to use the Card only for lawful purposes and in accordance with this Agreement. You authorize us to deduct the full amount of each purchase including taxes and any other fees from the Available Funds whenever your Card is used to make a purchase or to obtain cash through ATMs. You agree to keep track of the Available Funds on your Card by using the Customer Service Number or our website. You agree not to use the Card for any amount that exceeds the Available Funds or after the "valid thru" date printed on the front of the Card. The Card is not transferable and you agree not to permit any other person to use your Card. If you believe your Card has been lost or stolen, you agree to notify us immediately. See the section entitled "Lost or Stolen Cards/Refunds" below.

You acknowledge that purchases made with Travelers Cheque Cards are similar to those made with cash or travelers cheques. You cannot "stop payment" or lodge a "billing dispute" on such transactions. You may contact the Customer Service number and we will provide you with any transaction information we may have. However, you agree that it is your responsibility to deal directly with the establishment to resolve the matter. If you return any goods/services purchased with the Card and are entitled to a credit for the amount of the purchase from the establishment, you agree to accept the credit to your Card in lieu of cash. Your ability to obtain a refund or to return goods or services purchased with the Card depends on the establishment's return policies. There may be a delay of up to seven (7) business days before any amounts credited to your Card are available for spending.
 
SPECIAL USAGE NOTE CONCERNING "SPLIT TENDER" TRANSACTIONS/ COMBINING FORMS OF PAYMENT
If you wish to use your Card to purchase an item exceeding the Available Funds on your Card, depending on the establishment's policy, you may be able to use your Card toward a portion of the final purchase price, and then use another form of payment to pay the balance of the final purchase price. Please see the frequently asked questions accompanying this Agreement for guidance on completing a "split tender" transaction.
 
SPECIAL USAGE NOTE - USING YOUR CARD AT RESTAURANT AND OTHER "TIP" ORIENTED ESTABLISHMENTS
When a restaurant, or other "tip" oriented establishment (e.g., spas, hair salons, etc.) requests approval from us to complete your transaction, the establishment will often add a fixed percentage (approximately 20%) to the amount reflected on the bill presented to you prior to payment. This additional amount is meant to cover the tip that they expect you will add to the bill. TO AVOID A DECLINE OF, OR A HOLD ON, YOUR CARD, YOU CAN ASK THE ESTABLISHMENT TO AUTHORIZE A SPECIFIC DOLLAR AMOUNT. WE DO NOT GUARANTEE THAT THE ESTABLISHMENT WILL FULFILL THIS REQUEST. Please see the frequently asked questions accompanying this Agreement for guidance on avoiding a decline of the transaction and/or a "hold" on your Available Funds.
 
USAGE LIMITATIONS
Since Travelers Cheque Cards are prepaid cards, they are not intended for use in certain industries. You are NOT permitted to use the Travelers Cheque Card:
  • To reserve a rental car, or when picking up a rental car. However, at the end of a car rental, you can use your Card to pay for the rental.
  • To reserve a hotel/motel room, or when checking into a hotel/motel or other lodging establishment. However, at the end of your stay, you can use your Card to pay for your stay.
  • To pay for gasoline/petrol "at the pump" through automated terminals. However, you can use your Card to pay for gasoline by presenting the Card in the station or to a service station attendant.
  • To pay for "person-to-person" internet payment products such as "Paypal" or "YahooDirect."
  • To pay for telecom charges (including cellular, airplane telephones, payphones, home phone service, etc.)
  • To pay for recurring billing charges, such as health club memberships or subscriptions.
  • To make installment payments in the future for goods/services received in the present.
  • To pay for bail bondsmen.
  • To pay for detective agencies.
  • To pay for home repair services such as plumber, electrician, or painter/decorator.
  • To pay for internet electronic services including electronic mail, internet service provider, internet telecom, etc.
  • To pay for personal services such as escort agencies, introduction services, or massage parlors.
  • To pay for wholesale goods.
  • To pay for on-board cruise charges.
  • To pay for gambling.

We reserve the right to add merchant or purchase categories to this prohibited transaction list at any time in the future with or without cause, and without giving you notice.
