THE TRAVELERS CHEQUE CARD FROM AMERICAN EXPRESS CARDHOLDERS AGREEMENT (UNITED STATES VERSION)
|
ATM TRANSACTIONS
You may use your Card to obtain cash from ATMs operated by any bank or financial institution that participates in the Express Cash network maintained by American Express. Use of the Card at an ATM is subject to all applicable fees, surcharges, rules and customs of any clearinghouse, ATM network, or other institution or association involved with the transaction.
Personal Identification Number ("PIN") - Each time you wish to obtain cash at an ATM you must supply your PIN. To select your own PIN or to obtain information on the locations of participating ATMs, please call Customer Service at 1-888-412-6945 (within U.S.) or 1-801-945-9450 (outside U.S.) anytime. To ensure that no unauthorized transactions are made with your Card, you should take all reasonable precautions to prevent any other person from learning your PIN and using the Card. For example, never keep any material containing your PIN attached to or with the Card. Limits on Obtaining Cash - The daily limit on the amount of cash that may be obtained from ATMs is $400, £250 or €350. We may impose additional limits at our sole discretion (in addition to any limits imposed by the ATM's operator). Please note that if in any day you meet the daily ATM withdrawal limit, you can still use the Card to purchase goods and services at a merchant if you have sufficient Available Funds on your Card. Fees - We may charge a fee to the Card for each transaction at an ATM. This fee, depending on the currency of your Card, will be $2.50, £1.50 or €2. The ATM operator may also impose fees for use of the ATM. Our Liability for Improper Transactions - We will not be liable to you: (i) if the ATM or other location where you are making the transaction did not have enough cash; (ii) if the ATM was not working properly and you knew this at the time you started making the transaction; or (iii) any other exceptions stated in this Agreement. In Case of Errors or Questions About Your ATM Transactions - Call us at the number given above as soon as you can if you have a dispute or if you need more information about a Card transaction at an ATM. We must hear from you no later than 60 days after the date of the transaction. You must tell us your name and Card number, the date and dollar amount of the suspected error, and describe the error or the transaction you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information. If we ask you to put your complaint or question in writing, you agree to do so within 5 business days from our request. We will tell you the results of our investigation within 30 business days after we hear from you. For transactions initiated outside the United States, we will have 90 calendar days to complete our investigation, unless otherwise required by law. Discontinuing ATM Access - We, or any bank or financial institution participating in the Express Cash network, may add to or remove any or all ATMs or extend or limit the services provided at any location without notifying you beforehand. In addition to the foregoing, we may revoke your right to obtain cash from ATMs, at any time, at our sole discretion, with or without cause, subject to applicable law. We also have the right to deny authorization for any requested transaction, at any time, at our sole discretion, with or without cause, and without giving you notice, subject to applicable law. For Your Safety When Using an ATM, Please Observe the Following - If the ATM you are using is inside a building, close the entry door completely upon entering. Individuals who have a legitimate need to gain access to an ATM should have an access device. Put withdrawn cash in a secure place before stepping away from the ATM. Be aware of your surroundings. If you believe you are being watched or followed, cancel your transaction, then go to a well-populated area. If necessary, call the local police. Do not write your PIN on or near the Card. Do not give your PIN to anyone else. In case of an emergency, call 911. Note: Activity is being recorded by hidden cameras at ATM locations in New York City and/or as required by local regulations. ADDITIONAL TRAVELERS CHEQUE CARDS
You are eligible to have up to three (3) additional Travelers Cheque Cards (each an "Additional Card" and collectively, "Additional Cards") issued to persons you designate or you can purchase a total of four (4) Cards for different people, including yourself (each person besides yourself is referred to herein as an "Additional Cardholder" and collectively, "Additional Cardholders"). You agree that each Additional Cardholder will be a United States resident and at least thirteen (13) years old. You are responsible under this Agreement for the use of Additional Cards you have asked us to issue. If you have requested, or if you already have, a total of four (4) Cards linked to your Associated Account, you must contact the Customer Service Number if you want us to issue more Cards. We do not guarantee that we will issue you more than four (4) Cards and we reserve the right to limit any individual to no more than four (4) Cards at a time. You agree that you have informed your Additional Cardholders of how to use the Card and of the terms of this Agreement, and you certify that they have agreed to such terms. You are responsible, and agree that we may charge your Associated Account, for any Shortages, together with any applicable fees or charges, that may occur on an Additional Card. If you are an Additional Cardholder, then by signing or using the Additional Card, you agree to be bound by these terms and conditions. All
references to the term "Card" in previous and subsequent sections of this Agreement shall also refer to "Additional Card".
If an Additional Cardholder wishes to be primarily responsible for transactions on his or her Additional Card, or if an Additional Cardholder wishes to reload his or her Card using his or her own payment account, that Additional Cardholder must be at least eighteen (18) years old and must call the Customer Service Number to provide us with personal information sufficient to permit us to approve the individual as the responsible party for any and all charges, fees and other amounts (e.g., Shortages), that may occur on the Additional Card. Such person will have to review the Travelers Cheque Card terms and conditions and agree to them. Once we approve the individual as the responsible party, you will no longer be responsible for how that person uses his or her Card. In addition, the Available Funds on that person's Card will no longer be included in the total Available Funds applicable to your Card and any other Additional Cards for which you are responsible. |
